Man Hurt, Arrested In ATV Crash
A Benwood man in an all-terrain vehicle accident involving his 3-year-old son was arrested this week.
Rodney Jay Wayt, 25, and his son were both hospitalized Sunday after Wayt crashed an ATV while his son was riding with him on Roosevelt Avenue in Benwood.
Neither were wearing helmets at the time of the crash, according to Benwood Police Chief Frank Longwell.
Wayt was charged with child neglect resulting in injury. Bond was set at $2,500.
According to the criminal complaint filed against Wayt, the Benwood Police Department responded to Wayt’s residence at about 5:30 p.m. at 141 Roosevelt Ave. to a report of an ATV crash.
At the scene, officers discovered Wayt on the ground about 25 feet from the ATV.
Officers also said they found Wayt’s son upset and crying.
They reported finding scratches on the boy’s arms, legs and the right side of his head below the hairline.
A written statement from an eyewitness stated Wayt and his son were riding the ATV down the road when the ATV flipped on its side, causing Wayt and his son to fall off and skid down the road.
Wayt was transported to a local hospital, while the child was transported by medical helicopter to West Virginia University Children’s Hospital in Morgantown.
The status of the child’s condition was not available Thursday.
The day after the accident, Wayt gave a statement that he was traveling down the road and braked to enter his driveway when the ATV took a nose dive onto the pavement.
A pretrial hearing for Wayt is set for 3:15 p.m. June 3 in Marshall County Magistrate Court.
