Loud Music Leads to Harassment Complaint in Marshall County

What began as a noise complaint Wednesday ended with harassment charges against a Marshall County man.

The Marshall County Sheriff’s Department responded to 1126 Big Wheeling Creek Road in Wheeling concerning a late-night music complaint from various area residents. According to the criminal complaint, a deputy noted extremely loud music coming from the residence of 54-year-old Allen Douglas Earnest.

The deputy noted the music was coming from a speaker set up at the edge of the house directly facing Earnest’s neighbors on Clause Lane. He also noted an extension cord running from Earnest’s residence to the speakers.

When the deputy requested Earnest turn the music down he replied he had told the last officer who came to tell the department to stop coming to his home. When the officer advised Earnest he was in violation of a harassment code because the speakers were pointed directly at his neighbors’ homes, he reportedly claimed he wanted to call an attorney.

The deputy then went to Clause Lane, where he spoke with two neighbors, both of whom are in their late 80s. According to the complaint, they stated the music issue began after they would not allow Earnest to use a nearby right of way for his vehicle.

Earnest is charged with harassment. He is now free on $3,500 bond.
