Competency Evaluation Is Ordered in Belmont County Murder Case

A competency evaluation was ordered Monday in the case against one of several co-defendants in an alleged Bellaire home invasion that resulted in the death of one of the participants.

Michael Scott Posey, 33, of Bellaire, requested and was granted the evaluation. He is accused of robbery, aggravated burglary, murder and complicity to robbery and burglary leading to a death. His trial is set for Aug. 29, with bond remaining at $1 million.

Posey is one of several suspects who allegedly conspired with Joshua Gorayeb to steal narcotics from a house at 4157 Noble St., which investigators believe was a site of drug activity. Law enforcement believes Posey drove the car to the house while Gorayeb and co-defendant Thomas Earl Grubba, 34, of Wheeling attempted to enter the house.

However, the occupants were armed and Grubba and Gorayeb were both shot, with Gorayeb dying at the scene.

Other co-defendants are Diane Jean Kuri, 28, of Wheeling and James Dean McMasters, 46, of Bellaire. McMasters is believed to have been a resident of the house at one time.

All co-defendants face the same charges, including murder, because their alleged crime led to Gorayeb’s death. Bond for all four murder suspects remains set at $1 million.

Grubba’s trial date is set for Sept. 18, with Kuri’s Oct. 2 and McMasters’ Aug. 22.

Lola Eden, 54, of 4157 Noble St., Bellaire, the owner of the home, also appeared in court. She is charged with trafficking in drugs, trafficking in drugs with a firearm specification, possession of drugs and tampering with evidence. Her bond is $100,000 and her trial is set for Aug. 31.

According to the county prosecutor’s office, a large amount of cocaine was found in the house.
