Bond Set at $1 Million for Bellaire Murder Suspect

ST. CLAIRSVILLE — The man accused of shooting and killing Brad McGarry on Sunday is being held in lieu of $1 million bond after he appeared for arraignment Thursday.

David Carl Kinney, 30, of Brilliant is charged with murder with a gun specification in the fatal shooting of McGarry, 43, at McGarry’s Bellaire residence. Kinney appeared in Belmont County Eastern Division Court and had his bond set, although he did not enter a plea or receive his trial date. His next hearing was set for May 18.

According to the prosecutor’s office, a grand jury must indict an individual before a plea can be entered and court dates set. The grand jury already held its monthly session for May.

Kinney allegedly shot and killed McGarry during an altercation at McGarry’s home. Kinney was the individual who called 911 and reported finding McGarry’s body.

He was arrested when, according to the prosecutor’s office, he gave conflicting accounts about the crime during questioning.

Several other individuals were arraigned in Belmont County Common Pleas Court on Thursday, including a man accused of raping a 12-year-old.

Christianson Sean Hill, 32, of Wheeling, pleaded innocent to rape with the specification of compelling the victim by force or threat of force during a two-year period.

His pretrial was set for June 5 with a plea agreement deadline June 19 and trial July 11. His bond was set at $1 million. If convicted, Hill faces a sentence of 25 years to life.

A 12-year-old reportedly claimed Hill had threatened the child’s family if anyone was told about the alleged acts. According to the case files, the Ohio Bureau of Criminal Investigation matched DNA from Hill with the child’s rape kit.

In another case, Russell Conrad, 31, pleaded innocent to three counts of pandering sexually oriented matter involving a minor, which allegedly occurred Feb. 15. A pretrial hearing was set for May 30 with a plea agreement deadline June 12 and trial on June 27. Bond was set at $250,000. He faces a maximum sentence of 24 years.

Jessica Florence Spencer, 36, of 4627 Jefferson St., Bellaire pleaded innocent to child endangerment and driving while under the influence of alcohol or drugs, both allegedly occurring March 28. A pretrial hearing was set for Monday with a plea agreement deadline May 30 and trial June 6. A recognizance bond was set.

Mark Douglas Bell, 38, of 310 Main St., Morristown pleaded innocent to two counts of trafficking in heroin, which allegedly occurred Jan. 11, 2015. His pretrial hearing was set for Monday with a plea agreement deadline of May 30 and trial June 13. A recognizance bond was set.
