I re-read the article. It does not state that this guy was the aggressor. It states that there was a fist fight with a different man earlier in the evening, and this guy was bleeding, and did not want to press charges. So he fought with 2 different individuals on this evening before he died, and according to police, was intoxicated. Do the police ever write in their report that a person is intoxicated when they are not? Every intoxicated person is not the aggressor. Women who are battered often develop addictions and abuse alcohol-it does not mean they start fights (sometimes they do).

Both of these others guys took off before police came-that could be significant. Just like that biker that attacked the security officer at the mall-we take it lightly, but if that security officer died as a result, it does not matter how rude she was or what she did.

If there is information that this guy started the fights, its not in this article.

Castle defense comes to mind. It is a tragic that this incident played out the way it did, but this appears to be a freak accident.

Let's not forget the incident that occured down at Nail City not so long ago where a single punch also resulted in death. In that case, there was no guilt determined for murder, since the victim was also the aggressor.

Perhaps you are right that he was the aggressor. Correct to not jump the gun. However, the damage from fist fights is much greater than many think. Traumatic brain injury leads to mental health issues, then public assistance which none of us want. We often think of sports injuries or accidents, but many are from domestic incidents and unarmed fighting. Death is not the usual, but death is not the usual for drinking and driving either, but if you are one of the unlucky ones, statistics dont really matter.

Yeah, I would prefer to wait for more info as well. If the man was struck and left without aid, it can perhaps be manslaughter. It could also be manslaughter if it occurred as the result of a fight. It is not murder unless the attack was planned out with the purpose or intent. Striking someone during a fight does not normally have the expectation of death or serious injury. Hitting someone with a brick, car, or using a knife, gun,or other lethal instrument is different.

Bloomin: According to the article this was at least the second fight of the night for Demello. Perhaps it is self defense? I think I will wait for the complete investigation before jumping to conclusions. Demello sounds like the aggressor based on this article. He was the victim of his own stupidity and rage perhaps? I suspect he was drunk and looking for trouble. Unfortunately he got more trouble than he bargained for. Kinda reminds me of the Hocutt incident.

wrath-I dont disagree, but this is murder. The man that struck him needs to be charged with murder.

People around here think it is normal to resolve a dispute with violence, and you dont have to be trash to fall victim of this. The prosecutor needs to send a message that when you use violence, you are responsible for the consequence, and it may not be a simple assault charge. This is a no brainer. What are they waiting for. Remember kindergarten-keep your hands to yourself? PROSECUTE. If this guy were one of the prosecutor', magistrate's, cops, etc relative-would have been done. Head injuries leave people damaged for life when they dont die. WV has high rate of head injuries, leads to unemployment and welfare, or sometimes death.
