It used to be law enforcement people had a mindset of protecting the public and using the least amount of force necessary to do their jobs. Now they are taught to shoot first and ask questions later, if even the slightest hint of a possibility might exist that someone might get hurt. That is the major part of the problem... not 3 kids and a misguided young adult who do something stupid.

There is an us vs. them attitude among many police today that does not serve the public well.

He said the BB guns could easily be MISTAKEN by police as being REAL guns.

"If a person flashed one of these to police, that person could very easily be shot and killed," he said.

So you admit if police shot somebody with a BB GUN, it is "MISTAKE"??

And you ADMIT they are not a REAL gun??

I would HOPE that police don't shoot people for simply SHOWING something that LOOKS like a firearm.

If they do, there will be lawyers lining up to sue the city for miles.

Now IF somebody is DUMB ENOUGH to POINT what looks like a handgun at a police officer and make threatening statements or movements, they deserve to get Blown away. And their next of kin will get the Darwin Award 2014.

I'm SURE slumdog is salivating at the prospect of blowing away 12 year olds with BB guns with his AR-15 with laser sights.

Especially if they are exhaling carbon dioxide or worse yet, eating fatty Big Macs with Supersized fries.

Why Hail Yeah! Those kids need to get their guts splattered all over the cemetery. Why some of the residents there might get hurt from their actions... again.

If it looks like a functional firearm, the on-site LE officer must assume it is a deadly weapon and poses a credible threat to others. If the officer hesitates and the weapon turns out to indeed be real and is fired wounding or killing an innocent person the officer is legally responsible. At the least, his/her law enforcement career is finished. Once actual firing begins it becomes increasingly difficult to regain control of the situation. If your child carries a so-called "toy" gun into a school he/she may not be home that evening.

For awhile toy companies were forbidden to make toy replicas of real pistols as they were used in robberies, used to threaten others and in some cases pull on police officers who shot the person holding a realistic .45 aimed at them. Naturally in those cases the mothers got to wail on television and then try to make some money off the shootings, but in fact you don't know if these guns are real. Do you wait until your shot and die knowing that yup it was real. After awhile the restriction were reduced to making manufacturers put a red strip around the front of the air gun. The gang bangers, on line issued instuctions to paint an orange stripe on your gat so police won't think its real and you can kill the cops. Letting your kid have a realistic toy/air gun is dangerous. Oddly pro gun people side with the Crips and Bloods and the home invaders on this issue.

Have your kids go to Judge Sims or Mazzone and get their toys back, Leave their names so they'll receive a USMC/WVSP/DEA/US Marshals etc. application or career structure interview upon High-School Graduation.

Aren't there a few simple observations that could be made during situations like this. Perhaps the fact that the guns weren't going "bang bang" and no smoke was coming out. Also, the group was probably children laughing and playing, not being aggressive in any way. Was there racial profiling going on?..maybe.

Mt. Wood overlook is really a unique and cool place...it's such a shame that someone cares enough to call the police on children playing, but not enough to deter the trash and graffiti that seems to accumulate there.

Ok kids...go back to your XBOX...no playing outside anymore.

Some basic facts; law enforcement officers are trained in the use of deadly force, including when to employ it to save the life of a potential victim, including the officer's. Events contributing to a decision to employ deadly force often do not provide more than a few seconds to react to a perceived situation. A hand gun or long gun that closely resembles a functioning firearm must be treated as being real and able to cause death or serious injury. A teenager holding such a weapon and threatening others must be treated the same as a real threat. Every law enforcement officer wants to go home after work to be with his or her family, and he/she knows what a firearm is capable of in terms of causing injury or death. If you carry what closely resembles a functioning firearm there is a good chance it will be treated as an actual gun. In the end it could become a tragedy that should never have happened.
