Theme Park Plan Frozen Solid

WHEELING — Ohio County officials promised in July 2006 that local residents soon would be able to experience a “wild escape” at The Highlands.

Now, 18 months later, the proposed Wild Escape theme park seems no closer to reality than it was that summer day when officials announced the project — and judging by the process to date, that may not change anytime soon.

Add to that the possible $35,000 in fines the Ohio County Development Authority faces each day for improper work done across Interstate 70 from The Highlands, where streams allegedly were filled in without valid permits, and it’s easy to see county officials have a serious permit issue at the site. They have said the complications could threaten future development there.

At the center of the Wild Escape holdup are Clean Water Act permits that have to be issued by the U.S. Army Corps of Engineers.

Ohio County officials say they currently are waiting on approval from the Corps before they can move forward with the Wild Escape project, as they want to fill in several streams in an area known as Storch’s Run. Filling in Storch’s Run will require 13.7 million cubic yards of earth and cover up those streams.

County Administrator Greg Stewart in December told the Ohio County Development Authority he expected a response from the Corps concerning the permits by the middle of this month. That didn’t happen.

Scott Hans, acting chief of the Regulatory Branch at the Corps’ Pittsburgh office, said it is too early to say when — or if — permits will be issued for the planned theme park site, also known as Phase V of The Highlands development.

? Planning for a Wild Escape

Stewart said county officials originally applied to the Corps for the Wild Escape Clean Water Act permits in September 2006. “I am just really surprised at the amount of time it takes to get them (the Corps) to do these things,” he said.

Stewart still hopes the Corps will issue the permit that will allow the Ohio County Development Authority to create a level pad of about 125 acres to locate Wild Escape.

“We have been waiting long enough as it is, so I don’t even want to venture a guess as to how long it may take to get this permit. I really hope this theme park becomes a reality because it would be a great added draw to our site,” Stewart said, noting that in addition to the roller coasters and water slides of Wild Escape, Phase V also could be home to hotels and additional retail centers.

Hans said the Corps is reviewing county officials’ responses to the series of public comments made in September regarding the proposed earthmoving work for Phase V.

“We plan to get back in touch with them (county officials) to discuss this within the next few weeks,” Hans said.

He added there is no time-frame for making a decision on the status of the application. “Every developer wants us to give their application priority, but we have anywhere from 50 to 75 individual permit areas like this to work on each year,” he said.

Stewart said he believes the environment of the Phase V area is very low quality. “If we were asking them for permission to fill in somebody’s favorite fishing spot or something of that nature, I could see why it would be a problem, but that is not the case,” he said.

But Hans said Storch’s Run flows into Wheeling Creek, which flows into the Ohio River. “You have to consider the entire area that you may be impacting with this type of earthwork,” he said.

Stewart also said the county needs to complete work on Phase V before beginning work on Phase VIII, which is located in the space between the Cabela’s Distribution Center, Kohl’s, Wal-Mart and the theme park site. “Because of the way we have to move the dirt to fill in the valley, we have to do Phase V before Phase VIII,” he said.

Stewart said Phase VIII is a proposed recreation area that may include construction of a baseball stadium. “It is too early to say how big this stadium would be,” he said, noting the facility could be used by “players of all ages and abilities.”

Meanwhile, Wild Escape President Steve Minard said he has been working on projects in Nebraska and Texas while waiting for the Ohio County development to move forward.

“What I have always tried to remind people of is that Wild Escape is a very large earthmoving project. I believe we are getting very near the end of this permit process and should be able to get to work fairly soon,” he said.

Minard said most of the rides for Wild Escape already have been manufactured and are in storage throughout the nation. “When we get the pad ready, all we will have to do is ship the rides to Wild Escape and assemble them,” he said.

Although he said he would not mind sharing examples of the manufactured rides, Minard said he does not want any potential competitors to see what he has planned. “Kennywood and Cedar Fair (owner of Cedar Point) may want to use some of our ideas,” he said.

Minard said he believes there is a strong demand for a theme park at The Highlands. “When you look at everything growing in the area with (Wheeling Island Hotel-Casino-Racetrack), Oglebay Park and everything already going on at The Highlands, Wild Escape will be a great fit,” he said.

Minard stressed that he still is “fully committed” to bringing the park to The Highlands.

? $35,000 in Fines Each Day

It was during a routine visit to The Highlands on Oct. 4 that federal inspectors discovered the waterways known as streams 34 and 35 had been filled. Hans said workers under control of the county development authority performed the action without permits being issued.

Streams 34 and 35 are located on Lot 13C at The Highlands. Lot 13C is located on the south side of Interstate 70 — the side opposite Cabela’s and the planned Wild Escape site.

The allegedly unauthorized action carries a penalty of up to $35,000 a day in fines. Hans noted the U.S. Environmental Protection Agency would have the authority to impose the fines on the county as it sees fit, but EPA spokeswoman Donna Heron said any potential fines would not be levied until the ongoing investigation is complete.

Stewart said he gave the order to begin filling in the streams in question. “We believed we had the authority to do this work because it had been so long since we had heard anything from the Corps,” he said.

The county applied for the permit for the 25 acres of Lot 13C in January 2007, Stewart said. “Now, here we are a year later. I just don’t know why the Corps takes so long to do these things,” he said.

Stewart refers to the areas where the county performed fills as “alleged streams.”

“With the little bit of water there, I just don’t see why this is such a big deal” to the Corps, he said.

Though he is not sure if the EPA will assess fines against the county, Stewart said any fines will not be paid with money from the county’s general fund. “The Ohio County Development Authority will pay any fines,” he said, noting much of the OCDA’s funding is drawn from lease revenue and property transactions at The Highlands.

Despite the problems with permits and fines, Stewart said the county is still very optimistic about the future of The Highlands. “We think we have a pretty good thing going right now, and as long as we can get these permits, the site will get even better,” he said.

If I had the property and funds, I would have already begun construction. It doesn't take YEARS to get these permits. Months maybe but not years. SMOKE AND MIRRORS!

ED be d*a*m*n*e*d! I'm tired of ANY govt (or private business via govt) taking by force ANYONE's land for other than nat'l defense & the like (or in criminal proceedings). As a matter of fact, once the cnty threatened ED I would've stood on principle & told them to "shag" off & that they couldn't have the land for ANY amt of $.

FACT: OH Cnty was W/O permits for certain work & did it ANYWAY, PERIOD. What Stewart couldn't call the Corps the day HE gave the work order just to be sure? Of course not, b/c he probably figured they'd say NO & then he couldn't try any (flimsy) excuse to do the work. I don't by the "if you don't hear from us" crap & even IF the Corps said that then Stewart is still a fool for not calling to make sure it was legal to proceed. He should've practiced "CYA" BEFORE ordering the work INSTEAD OF AFTER.

WVUGrad, Remember I said that even if he asked for $5M pay it/be SOL. It's HIS LAND & he should get what HE WANTS or NO SALE REGARDLESS of the wealth of ANYBODY. FACT: It's "on the record" in the form of a N-R article in Nov-O'Brien's lawyer said "We want $1,037,000 for that property,” So how you're getting $2M etc as "last asking price" I don't know--yes in '06 he asked for $3M (but still I say SO WHAT it's HIS land) & the cnty said $15K w/ the appraisal being much + than the cnty offer while being much - than O'Brien's (but still--SO WHAT it's HIS land). In the same article, McCormick said developers could construct the rd a different way if they don't get the property--so the county should pay up or use that different way (W/ valid permits) & stop bellyaching & throwing the blame onto O'Brien & of course if that happens & he doesn't get to sell HIS property & gets Zip then so be it too that's the risk in any property negotiation.

ovvllyres has a GREAT idea! Let's throw in jail, the one man who is actually making a difference FOR the people of Wheeling / Ohio County. Better yet, 50 lashes!!!! Here is a man who works tirelessly, hoping that someday OUR children will actually be stay here, and make a decent living. Are wages produced by these type of jobs going to support a family? Probably not. BUT ITS A START! Name one other person or group of people in this Ohio Valley that has even come close to what Stewart has accomplished in the past 5 years. Instead of criticizing, maybe you ought to walk up and just say: THANK YOU.

Ahhhh - I am about ready to collect a debt. I have been saying for months that this theme park idea is NOT going to materialize - and at no fault of the corps OR Ohio county. I remember years ago when someone tried to start a theme park near New Concord, OH - called "Paradise Lake" - fell flat on it's face. The amount of capital needed to start a project like this is ASTRONOMICAL - and I believe way beyond the reach of Steve Minard. PROVE that these rides are in storage somewhere - I bet they don't even exist. And other parks wanting to "steal" the designs? BS - Cedar Fair doesn't need to STEAL any ideas - they have some of the best in the business creating their attractions. Plus the guy just looks sleazy to me. We'd be better off with an indoor water park like Great Bear Lodge.

WVUGrad. You have to be one of the Commissioners. And you know Mr. O’Brien’s last demand was for the appraised value of the land. $1,037,000. And you know the County Assessor has just set the fair market value of the property for tax purposes at $829,100. Isn’t it time to bury the hatchet? For the good of the County. Please, buy the land, end the dispute and build Wild Escape.

It's time for the citizens of Ohio County to let the Pittsburgh Army Corps of Engineers know what we think of them. E-mail them at lrp.webinquiries@usace.army.mil and tell them we want the permit issued for the theme park to help save a $200 M investment in our county.

Our tax dollars pay their salaries and they have failed miserably.

ohvllyres needs to get his facts straight. Poor "Mr. Obrien" Richard's last asking price was around $2M, not 900K. He couldn't make up his mind which Mercedes he wanted to buy with the tax payers money. Poor "Mr. Obrien" Richard lives in one of the wealthiest neighborhoods in the USA, Cherry Hill, NJ. There is nothing poor about "Poor" Richard.

As far as the permit situation, the county was told by the Corps of engineers that if they did not hear back by a certain date they were clear to start work. The county waited past that date to start work and because the corps of engineers has their own agenda they did not respond until after work had started to cry foul.

The permit was applied for in January 2007 when the county was told it would take 45 days for a permit. The county is still waiting because the corps is busy screwing some other developer who wants to fill in some worthless stream on a side of a hill or some ditch with one cattail growing i

WVUGrad- I hope it does come but I don't see it. He's been a "few months away" from building Port Nebraska for several years. I just wonder how he's paying to store all these rides around the country for this long. It's not cheap to warehouse an amusement park.

PoorRichard, IMHO...REGARDLESS of SCOTUS, since the land isn't for natl security or some such purposes...if Mr. O’Brien had said he wanted $5M for the land then pay up or be SOL...BUT he didn't...instead he asked for what turned out, as you said, appx 10% over the accessors amt but the county isn't actually going to "save" the 10% instead they're going to end-up paying more than that when you + in the $ lost in fighting Mr. O'Brien over HIS LAND. BTW to the coal complainers, the old "but they do it so I should be able to" crap w/ the examples of coal permits is just that--crap. Coal permits have NOTHING to do w/ this SPECIFIC matter.

But my real comment is on the earlier posts about not bringing high paying jobs, instead, it'll only bring low wage jobs. couldnt agree more. The best chance this place has to survive is to essentially become a suburb of the suburbs. Did you notice how the I-79 cooridor is expanding (due to our high taxes here in Allegheny Co, PA) with both corporate and residential communities? It is, at an unbelievable rate. Build on this concept. Little Washington (yes, that's what we called it as kids) is growing exponentially adn leaving Wheeling and the cities of its ilk in its wake. That's because they're courting businesses to come at low property and tax rates, adn not pushing for 'theme parks'. Leave that stuff to Walt Disney.

this is not what wheeling needs. these water theme parks have been closing left and right in recent years. as for drawing people to the valley, some, but all spending will be limited to the highlands. Ive been to water theme parks (Erie, Va, etc) ALL the money stays there. You stay at the local hotel, eat at the garbage chains surrounding it, adn go to the park. Adults dont go to these with kids, then 'drag' them shopping in the nearby town (wheeling). You wouldnt do it, and neither would they.

As for the environmental comments, you have no idea what you're talking about. Ive been in the industry before 'green' was the new value of the nation. Groundwater beneath adn surrounding that stream is also likely being impacted from the hazardous runoffs. Ive seen too many people get cancers, tumors, etc. from these kinds of flipid answers. Trust me on this.

Here is an example of use of that 'logic' elsewhere: Someone applies for a job--2 months later doesn't hear back then that someone just shows-up @ the job & goes to work...same 'logic' & same utter nonsense. He KNEW they DIDN'T have permits & he ADMITS ("alleged" not in play) he ordered the work anyway. IMHO, he should be in jail/@ least personally fined. If I were in charge @ the Corps I would DENY the permit based JUST on the fact that the county KNOWINGLY did work w/o a permit. I say KNOWINGLY b/c they didn't have the permits in their possession when they did the work...none of this "alleged" crap. If this were a story JUST about not having the permits YET & ALL the work being HELD-UP then I'd be on the county's side BUT that ISN'T the story...story = UNAUTHORIZED/NOT PERMITTED wor

Not only does he propose multi million dollar developments in WV and Neb on these laughable sites but he also sells Star Wars and Star Trek collectibles. Sure sounds like the next Donald Trump. The contact info for this "corporation" is a rural house in Iowa and a cell phone out of Omaha. I'd love to see something like this come to the Ohio Valley but this whole thing makes zero sense.
