County Seeks TIF Bond Rating

Stamp of approval may mean better interest rate for Highlands funds

WHEELING - In May 2006, Ohio County Commissioners issued $99 million worth of tax increment financing bonds through West Virginia's first and only sales tax TIF.

Commissioners now want Standard & Poor's to declare those bonds - issued to fund development at The Highlands - worthy of investment grade ratings.

"This would be a stamp of approval from the investment market," county Administrator Greg Stewart said following the special Thursday commission meeting, during which commissioners approved an order seeking the ratings.

"This could help us get a lower interest rate for any future development we do," Stewart added.

"It would look good to any potential investor if we could get the bonds rated," Commissioner David Sims added. "We believe our track record gives us a good chance to get them rated."

TIF is a tool that permits governments to use anticipated gains to finance improvements that are expected to create those gains. Through the county's TIF, the sales tax collected by businesses at The Highlands goes toward paying off the $99 million. Stewart said roughly 60 businesses at The Highlands collect the sales tax used to pay off these bonds.

Stewart said a company known as ORIX USA, based in Dallas, Texas, holds $81 million worth of the bonds. These bonds are of the taxable variety. The remaining $18 million, Stewart said, are non-taxable. These are held by several entities, though Stewart said a "big piece" of them originally went to Wells Fargo.

According to Standard & Poor's, bond ratings can range from the highest rating of "AAA," down to "D," which reflects a default. The company bases bond ratings on three major factors:

  • Likelihood of payment;
  • Nature of and provisions of the obligation;
  • Protection afforded by, and relative position of, the obligation in the event of bankruptcy, reorganization, or other arrangement under the laws of bankruptcy and other laws affecting creditors' rights.

"In this economy, it is significant that we have a chance at this," Stewart said, noting he has been in contact with S&P officials. Stewart said they should know if the bonds will be rated "sometime next week."

Commissioners also said the bonds allow them to develop The Highlands without putting the county's taxpayers at risk.

"If every store closed, the bondholders would lose their investments," Commissioner Randy Wharton said in emphasizing the action poses no risk to taxpayers.

The $99 million sales tax TIF, commissioners said, is unrelated to $26 million property tax TIF they received permission to issue in 2004. Commissioners are currently awaiting for approval from the West Virginia Development Office to issue $30 million in additional property tax TIF.

Stewart and commissioners previously said the $6 million of this $30 million would go to the West Virginia Economic Development Authority to repurchase the 32 acres of land the county sold to the authority last year.

Though commissioners have to this point declined to pinpoint exactly how they propose to use the additional $30 million, the planned Wild Escape Theme Park could be one area of emphasis. Other plans have included construction of hotels, additional retailers and restaurants, and even a sports stadium.

A lesson I learned early in life is that there is no free lunch. The above excerpt is more of the same finance games that brought on the Great Recession.

billy: I am suggesting public support for manufacturing vs service.This was done with great success in Pittsburg.The Clarksburg airport is humming with defense contractors who hire 5000+ at top skilled labor wages.The DOD budget will hit 1 trillion this year.Suggestions of this natue have been turned away by the Commission in favor of retail.

Before we make any decisions based on what we read or hear in the media, we should inform ourselves of the facts. One headline or “news-bite” or “sound-bite” is NOT NEWS. It is just an “attention-grabber” as Mr. Hefner knows. He loved the attention until his actions were proved WRONG, in a court of law.

Mr. Hefner, why ARE you so angry and bitter about everything? I don’t think it’s because you lost the election for the position for which you were running. You were a bit mean and nasty before that; but you’ve become even more mean and nasty. You seem to be always complaining about something; but you never seem to appreciate the good things, or give credit where credit is due.

Those of us who read about "truths" in the media should also remember that there is very little truth in the media.

The media is there, not to inform the public as intended; the media these days seeks STORIES that will become headline that will bring revenue to the newspaper.

Ellis: Cabellas etc are great-very attractive. But they are not solution to the underlying problem in the OV.The problem is the decline of manufacturing and the solution is the return of at least light manufacturing.This creates wealth and the payrolls for people to consume at the Highlands.Murray makes a good point: his 500 mines support probaly 2500 service jobs.Or 3000 total.Murray has a probable 20 million/year payroll.This is spent-or not spent - at Highlands.However one job at Pennys or Olive Garden is not going to create five more.

Pittsburg has worked wonders in this area of redevelopment with voluminous public support.

At risk of sounding conceited, I must say that I am the original Ellis Wyatt. At least on this board.

As for the Highlands-what atoddh said is absolutely correct. Any commercial enterprise that must be financed by government is not a worthy enterprise. If you cannot attract the private sector to risk its' capital, it is not a worthwhile investment.

I have many questions. Perhaps Mr. Sims can answer them.

1)Cabela's has received almost $100 million in taxpayer funding. Has this brought a decent return?

2) The Highlands owes $220 million and collects less than $3 million per year in rents. Is that a decent return?

3) If the taxpayers, the county, etc. are not on the hook for the Highlands debt, who is?

4) Is it possible to sell bonds to the public without identifying the party issuing the bonds?

5) Has the Highlands created the promised 2,000 jobs paying an average of $26,000 per year?

6) Has Cabela's kept it's wage & benefit promises?

If Highlands is a good project,why not sell to a private operator and move on to value added projects with well paid jobs to replace those lost at W-P et al.The area can not survive without industry of some sort.Retail is not an industry.

Billy: The original intent of the Highlands property was the Fort Henry Industrial Park - not a retail center. The State provided something like 30 million in equity. Clarksburg and Morgantown ae booming with defense contractors of all sorts recruited by Byrd and Mollohan.Meanwhile Wheeling has asked for- and received- 10's of millions for WNHAC and dubious projects at Wheeling College. The notion that service is somehow going to replace industrial jobs is not correct.Eventually- without industrial and mining payrolls- there will be no customers for Highlands.The priorities are backwards for the situation. A huge new wind turbine plant is under construction in Western PA.No effort was made to attract the project to the OV,as an example.

Mr. Sims: I am neither angry nor bitter. I just want completely transparent government. I will admit that our national financial crisis does stir my emotions, but again, I think service to the people is a sacred trust, and I think unless our office holders can offer that, they should be replaced. Contradiction perks my ears, and locally, it is just too prevalent.

Hefner - not true. We were never in arrears on loan payments. As usual you don't know what you are talking about. The Governor has never been a fan of the sales TIF but he has been very supportive of the Highlands. He has been at many ribbon cuttings (see e.g., Cabela's, Sheetz, West Liberty campus, etc.) Doesn't sound "at arms length." You called for an investigation by the federal criminal prosecutor (the US Attorney). And by the way we get audited every year by the State and it is clean.

SIMS - At the time the to which you refer was written the OCDA was seriously in arrears on payments perhaps even in escess of the figure stated but your continued borrowing has I think temporarily solved that problem. The Governor was very distraught with your sales tas scheme and was holding the project at arms length. I never suggest federal criminal violations, however, I don't think a federal audit of taxpayers funds would be a bad idea.
