Former prosecutor faces Ohio disciplinary hearing

HAMILTON, Ohio (AP) — A former prosecuting attorney in southwest Ohio is facing a state disciplinary hearing for alleged prosecutorial misconduct including withholding evidence.

The Ohio Supreme Court Board of Commissioners on Grievance and Discipline has set July 31 and Aug. 1 for Jason Phillabaum's (FIL'-uh-bahmz) hearing. He's been accused of altering grand jury reports in two cases and of failing to disclose evidence in a case in which a Miami University student was convicted of gross sexual imposition.

The conviction was later thrown out over the withholding of a handwritten statement by the accuser that contradicted trial testimony.

The former assistant prosecutor in Butler County pleaded guilty in 2011 to a misdemeanor count of neglect of duty.

A message was left for him Wednesday at his private law practice in Cincinnati.
