City Files Motion to Dismiss FOP Lawsuit

WHEELING - City officials have filed a motion to dismiss the Wheeling Fraternal Order of Police Lodge 38's lawsuit seeking to invalidate voters' decision to overturn a law requiring two officers inside each patrol car.

The filing disputes the FOP's timeline of events leading up to council's decision to put the law before voters, and questions why the organization waited nearly two months after that decision to file its lawsuit.

City voters on Nov. 6 overturned the two-officer cruiser mandate by a nearly 2-1 margin.
