Psychologist to Evaluate Alleged Sex Offender Before Trial Is Set

Ohio County Circuit Judge David Sims will wait for a psychologist to evaluate Andy Eureka before rescheduling his trial on sex crimes he allegedly committed against a juvenile female in August.

An Ohio County grand jury in September indicted Eureka, 29, of Triadelphia on charges of first-degree sexual assault, first-degree sexual abuse and sexual abuse by a custodian. He has remained lodged in the Northern Regional Jail in Moundsville in lieu of $150,000 bond since being arrested on Aug. 11.

Eureka is accused of sexually assaulting and abusing a 6-year-old girl while he was babysitting the child on Aug. 8 at a home in Triadelphia. He allegedly admitted to committing the crimes in an interview with an Ohio County sheriff's deputy, according to court documents.

Sims ordered that Eureka be transported to the Western Regional Jail in Barboursville, W.Va., no later than Nov. 30. Dr. Bobby Miller will evaluate Eureka on Dec. 3 at the jail. Following the evaluation, Eureka is to be transported back to the Northern Regional Jail, Sims ordered.

Eureka also waived his right be tried on the charges against him during this term of court.

Sims during docket day proceedings in September scheduled Eureka's trial for Dec. 3 - now the date when his psychiatric evaluation will take place.

Sims will wait until docket day in January following the next meeting of the grand jury to schedule a new trial in the case.
