Reserve Benefits For Deserving Claimants

Unemployment compensation benefits are supposed to be reserved for people who lose their jobs due to no fault of their own. But in West Virginia, the system's history of abuse has encouraged more of it.

Until now, possibly.

A woman fired from a Charleston hospital for sleeping on the job, despite three written warnings, sought unemployment compensation. Turned down, she went to court.

Last week, in a unanimous ruling, the state Supreme Court upheld a lower court in rejecting the woman's claim.

A distressing aspect of the case is that, again because of the history of unemployment compensation being abused, the woman and her attorney thought they had a chance to prevail.

Supreme Court justices, in rejecting her claim, may set an example. Let's hope it leads to eliminating abuse of the unemployment compensation system once and for all.
