Attorney Resigns From Case of Elderly Robbery

Assistant public defender Keith Hart resigned Tuesday from the case of Timothy Terrance Belle - accused of robbing an 85-year-old man last year - following Belle's request that a new attorney be appointed to represent him.

An Ohio County grand jury indicted Belle, 29, of Toledo in May on charges of first-degree robbery and entering without breaking.

He has remained in the Northern Regional Jail in Moundsville since May 5.

Although Hart told Circuit Judge David Sims about Belle's desire for a new attorney two weeks ago, Hart has remained on the case while Belle sought to hire new counsel; Hart was appointed to the case.

On Tuesday, Belle said his search for a new attorney was unsuccessful and asked the judge to appoint a new defense lawyer. Hart cited a "breakdown in communication" between him and his former client.

Sims will appoint a new defense attorney to Belle's case during docket day proceedings Sept. 19. The judge will also issue a new trial date in the case that day.

Belle allegedly entered Thomas Biehl's house on Wood Street in September 2012 and demanded Biehl empty his pockets. When the homeowner refused, Belle allegedly shoved the man to the couch and shoved him again when Biehl stood up. Biehl eventually forfeited his wallet.
