County Wants Out of Jail Bill

WHEELING - Shelton Cash was charged with possession of child pornography in Ohio County in late August, but the images were captured in Kanawha County when Cash allegedly performed sex acts on a 12-year-old girl.

And although he was transferred from the Northern Regional Jail in Moundsville to the South Central Regional in Charleston soon after his arrest, Ohio County has continued to foot Cash's jail bill because it filed the first charges.

Ohio County has been charged $48.25 every day since Aug. 26, when Cash, 44, of Elkview was arrested by State Police in Wheeling. Cash's jail bill for September was $1,447.

"This is something that we face frequently - paying for people that are lodged in jail - and you can see how quickly it adds up," said Prosecutor Scott Smith.

Additionally, Cash is expected to be prosecuted in Kanawha County - where he since has been charged with multiple counts of sex assault and abuse, as well as manufacturing child porn - before he is tried in Ohio County.

In an effort to get Ohio County off the hook for Cash's jail bill, Smith dismissed the child porn charges against Cash, then re-filed them. That made the Kanawha County charges the first filed, and forces that county to pay for Cash's incarceration.

As of Friday, however, the paperwork had not officially been finalized, and Ohio County was still being billed for Cash's jail fees.

State Police arrived at Cash's Wheeling Island residence on Aug. 26 with a search warrant for his cell phone. The alleged victim, who lived with Cash, told a Kanawha County sheriff's detective Cash had taken pictures of the sex acts with his phone.

Troopers reportedly found five cell phone images of Cash and the girl engaged in sex acts. They also recovered a loaded handgun under the pillow on Cash's bed. He was charged with being a felon in possession of a firearm, but that was dismissed and not re-filed with the child porn counts.

Cash was convicted of first-degree murder in 1992 while incarcerated in the West Virginia Penitentiary in Moundsville. He served 16 years and was paroled in 2008.

Cash was arrested on the most recent charges at a Youth Services Systems facility on Indiana Street, where had been staying for about three months. The building sits right next to the YSS-operated Wheeling Community Childcare Center on North Huron Street, a day care service for 2- to 12-year-olds.

Cash represented himself to be homeless when he reached out for assistance, YSS Executive Director John Moses said. But following his arrest, Cash told police he was living at the YSS facility and working locally during the week, but returned to Kanawha County on the weekends.
