ST. CLAIRSVILLE - With a stern lecture from the judge on Monday, Kenneth Eugene Cunningham was sentenced to five years in jail after being found guilty of his 10th DUI.
Belmont County Common Pleas Judge Frank Fregiato expressed disdain for Cunningham because he failed to show remorse for his convictions, nor did he offer an apology to the court for his actions. Cunningham did not speak during Monday's proceedings.
Cunningham, 43, 65290 Willow Grove Road, Neffs, was given the maximum sentence of five years for driving under the influence, a felony of the third degree occurring April 9, 2013. His license also was suspended for life. A full jury trial reached a guilty verdict.
Defense asked Fregiato to consider that during the latest offense he was driving a four-wheeler rather than a motor vehicle. He had crashed the four-wheeler and the investigating officer suspected the involvement of alcohol.
Fregiato noted Cunningham's lack of remorse and failure to attempt reform. He also noted the threat posed by such reckless behavior.
"I'm shocked that you've been permitted to walk around the streets of this county," Fregiato said. "If the law allowed, I would give him more than five years."
In other proceedings, Michael Joseph Runnion, 24, 400 Center St., Martins Ferry, admitted to the violation of his probation and will serve the 324 days remaining on his sentence. He was convicted of attempted unlawful sexual conduct of a minor, a felony of the fourth degree occurring Jan. 1, 2011.
Steven Albert Barone-Byron, 24, 1825 N. Ninth St., Martins Ferry, was sentenced on his second count of domestic violence, a felony of the fourth degree occurring Feb. 7, 2014. He was given 18 months of community controls. He will serve six months jail, six months EOCC.
Mark Nicholas Brown II, 22, 4314 Franklin St., Bellaire, pleaded guilty to aggravated assault, a felony of the fourth degree occurring March 1, 2014. Sentence was set for April 28. A pre-sentence investigation, victim impact statement and EOCC evaluation were ordered.
Jacob Greywolf Hale, 21, 129 South Huron St., Wheeling, pleaded guilty to burglary, a felony of the third degree occurring Feb. 11, 2014. Sentence was set for April 28. A pre-sentence investigation, victim impact statement and EOCC evaluation were ordered.
Corey Michael Newlon, 26, 2385 Broadway St., Martins Ferry, pleaded guilty to theft, a felony of the third degree occurring Dec. 22, 2013. Sentence was set for April 28. An EOCC evaluation and victim impact statement were ordered.
Sloma Esther Waryck, 25, 65659 West Echo Road, Neffs, pleaded guilty to endangering children, a felony of the third degree occurring Jan. 17, 2014. Sentence was set for April 28.
Miranda A. Bonfini, 26, incarcerated, asked that her community control sanctions be revoked. She was sentenced to 12 months less time served for possession of drugs, a felony of the fifth degree occurring Dec. 30, 2011.
Christopher Allen Rock, 23, incarcerated, admitted to violating his probation and saw it revoked. He will serve the remaining five months of his sentence, consecutive with a sentence of seven months from another court for a total of 12 months. He was originally convicted of breaking and entering, a felony of the fifth degree occurring Oct. 16, 2011.
A warrant was issued for Ricky Joe McGuire, 24, 65160 School St., Neffs.
