$5.9M Awarded To Family of Marshall County Victim

A jury has awarded the family of a Marshall County resident $5.9 million after the owners of the former Speedway store in Glen Dale were found to be partially responsible for the man’s death.

In September 2015, a vehicle driven by a Speedway employee crashed into Kevin Jarrett, 59, who was driving home from work on his motorcycle. A prior jury had found that the Speedway employee was 70 percent at fault for the accident, while Speedway was 30 percent liable.

Greg Gellner, of Gellner Law Offices, and Bob Fitzsimmons, of Fitzsimmons Law Firm, both of Wheeling, represented the plaintiffs in the case, which was presided over in Marshall County by Circuit Judge David Hummel. The trial concluded on March 3.

In a statement, Gellner and Fitzsimmons said Speedway was responsible by allowing the employee to work heavily impaired by exhaustion, apparently falling asleep standing up before being made to continue her shift into overtime.

Additional damages had previously been assessed in the same case, awarding an additional $830,087 to the family, bringing the total award to the family above $6.6 million.
