Case against for Belmont County commissioner Mark Thomas dropped

ST. CLAIRSVILLE — Belmont County Common Pleas Judge John Vavra dismissed the civil case against former county commissioner Mark Thomas on Wednesday.

Vavra said the plaintiff filed a notice of voluntary dismissal without prejudice. Vavra added that the plaintiff, Kathy S. Amos who has power of attorney for Alma Lukas, has one year to re-file the case if desired.

In January, Thomas served a 30-day sentence in the Belmont County Jail for contempt of court for failing to comply with a court order to turn over documents to the plaintiff’s attorney, Andrew Walther. The documents are related to Thomas’ time as power of attorney for Lukas, a former client of Thomas’ now-closed legal practice. Vavra said Wednesday that Thomas had complied with the court’s orders by finding and turning over additional documents. Thomas had been scheduled to appear in court Friday before the case was dismissed.

The lawsuit filed by Amos is unrelated to Thomas’ time as a county commissioner. Thomas is no longer licensed to practice law, and he lost his November bid for re-election as a commissioner in 2018.
