Trial Set Feb. 26 for Former State Senator Maroney

A jury trial for former State Sen. Dr. Michael Maroney for the charges of indecent exposure, disorderly conduct and driving under the influence stemming from arrests in August and September of last year has been set for 9 a.m. Feb. 26 in Marshall County Magistrate Court.

A pre-trial hearing has also been set for Feb. 19, at 3:15 p.m. Marshall County Magistrate Zachary Allman will preside over the hearing and trial.

Allman ruled that a jury trial would be held for the charges during a pre-trial hearing on Jan. 8. The charges of indecent exposure and disorderly conduct stem from an Aug. 4, 2024, incident during which Maroney was allegedly seen committing an act of sexual gratification on closed-circuit cameras at the Gumby’s in Glen Dale.

Maroney was arrested on Aug. 13, 2024, by the Glen Dale Police Department.

Maroney’s DUI charges stem from a Sept. 23, 2024, incident where Maroney was allegedly seen driving erratically near Center McMechen Elementary by McMechen Police Chief Robert Shilling. According to the criminal complaint filed by Shilling, Maroney was “uncoordinated and speaking quickly, slurring his words” when Shilling pulled him over.

Shilling said Maroney failed several field sobriety tests. Maroney blew a .000 on a breathalyzer test administered by Shilling, and Shilling arrested Maroney on suspicion of DUI-drugs.

During the Jan. 8 hearing, the court ordered Maroney to enter and undergo a drug treatment program, either inpatient or outpatient, within a week from the hearing as a condition for the DUI arrest.

Maroney’s attorney, Harry Moore, motioned that the condition of rehabilitation not be enforced against Maroney as the results of his blood drug testing and a urine sample were “well below any intoxicating levels.” Allman upheld the pretrial bond conditions imposed on Maroney due to amphetamines and cocaine metabolites being present in a copy of the forensic lab report filed by Moore.

Allman stated he was not saying the drugs found in the results were “at intoxicating levels” but would uphold the pretrial conditions due to drugs being present in the results.

Allman also denied Moore’s motion to dismiss the case, which Moore based on Maroney’s “negative” drug test results and .000 breathalyzer test result from Sept. 23, 2024.
