Fitzsimmons Law Firm of Wheeling Part of Antitrust Lawsuit Against Google, Facebook

HUNTINGTON — The Fitzsimmons law firm of Wheeling is among a group of attorneys representing Huntington-based HD Media in an antitrust lawsuit against Google and Facebook, which charges the two companies with monopolizing the digital advertising market.

HD Media LLC, which owns the Charleston Gazette-Mail, the Herald-Dispatch in Huntington and a half-dozen weekly newspapers, filed a 42-page complaint against Google and Facebook in federal court for the Southern District of West Virginia.

According to a release from HD Media, “Google has monopolized the digital advertising market to such an extent that Google has been enabled to extract a supracompetitive share of HD Media’s advertising revenues, harming the company’s ability to effectively monetize its content.”

The complaint also alleges that Google and Facebook “violated antitrust laws by conspiring to further their worldwide dominance of the digital advertising market, entering into a secret agreement codenamed ‘Jedi Blue’ to manipulate online auctions.”

Robert Fitzsimmons of the Fitzsimmons law firm successfully sued the NFL in 1997, seeking disability lawsuits for former Pittsburgh Steelers Hall of Famer Mike Webster. That lawsuit led to a link being formed between repetitive head trauma suffered in football and concussions.
