Court Rules Oglebay Deer Hunt is On

Circuit Judge Jason Cuomo has ruled to dismiss the petition filed by Wheeling locals to cancel Oglebay's urban deer hunt. He found the 14 locals who filed the petition to have no standing as they could not prove they would suffer "sufficient, concrete and particularized injury" due to the culling.
Cuomo explained petitioners "failed to identify or present any specific, common law, statutory, or constitutional claim or right in and to the deer in question."
By failing to establish the claim to any deer, the judge outlines that Toriseva Law, representing the petitioners, suffered no "concrete and particularized" injury to give the suit standing.
Without standing, the court lacks the jurisdiction to preside over this case, requiring them to dismiss the case.
Cuomo also concurred with Oglebay attorneys in the filing that plaintiffs "suffered no invasion of a concrete legally produced interest because they have no ownership interest in the deer and no legal right to prohibit hunting."
The Oglebay Urban Deer Hunt is scheduled for Nov. 6-8.
