Neither Sen. Shelley Capito, R-W.Va., nor Sen. Joe Manchin, D-W.Va., should fall for President Barack Obama’s ploy to use a Supreme Court nomination to further his vendetta against coal and reasonably priced electricity.
Obama this week nominated federal appeals court Judge Merrick Garland to the Supreme Court, to fill the vacancy created by the death of Justice Antonin Scalia.
As some observers predicted, Obama picked a nominee he hopes will persuade conservative senators he is not a liberal ideologue. Garland has been described as a moderate jurist.
But on some issues, he can be relied upon to back Obama’s agenda. As The Associated Press reported, Garland “would be expected to align with the (court’s) more liberal members on environmental regulation, labor disputes and campaign finance.”
Obama is perfectly willing to nominate someone who will be moderate on some issues – but he is determined to have someone on the high court who will further his radical environmental agenda. Senators should see through the president’s tactic and refuse to confirm Garland.
