Powerline Park Closes in St. Clairsville
ST. CLAIRSVILLE — A privately owned ATV park where a Pennsylvania firefighter died nearly two years ago has closed.
Powerline Park, located about 4 miles west of the Ohio Valley Mall off Hammond Road at 69560 Lee Road, announced on its website that the park has been unable to secure enough liability insurance to allow it to remain open. Mike Derosa, co-owner of the park, said Monday that even though the park is closed for the 2018 season, the Grand National Cross Country race scheduled for October has its own insurance that will keep the park covered during that event only.
However, he said, “As a fun run, off-road park, that does not look like it will go forward.”
Derosa said the owners may decide to turn the land back to farming or raising cattle. He declined to comment on whether the insurance issues were related to the death of Mark Magazine, who died in an accident at the park in 2016.
“(The insurance) does not give us the coverage we need,” said Derosa. “This abruptly came to our attention.”
An ATV struck Magazine at the park during Memorial Day weekend 2016. The Republic, Pennsylvania, resident was 45. He was pronounced dead at the scene.
Tonya Ann Morehead, the driver of that ATV, and Shawn Lincoln Cape, her passenger, were sentenced in August for causing Magazine’s death. Police had said Cape had a handgun and alcohol was a factor in the crash.
Cape, 53, of Hiller, Pennsylvania, was sentenced to four years in prison for aggravated vehicular homicide and improperly handling a firearm in a motor vehicle. Cape’s driver’s license was suspended for five years.
Morehead, 39, of Mount Morris, Pennsylvania, was sentenced to five years in prison for aggravated vehicular homicide. Her driver’s license was suspended for life.
